Summer Send-Off Giveaways

The Summer Send-Off Giveaways (the “Contest”) is sponsored by Legends Global on behalf of Mohegan Arena at Casey Plaza, located at 255 Highland Park Blvd.; Wilkes-Barre Township, PA 18702 (collectively, the “Sponsor”). By entering this Contest, participants agree to be bound by these Official Rules and the decisions of the Sponsor, which are final and binding in all matters related to this Contest.

The Contest is open to legal residents of the fifty (50) United States and the District of Columbia who are twenty-one (21) years of age or older at the time of entry. Employees, officers, directors, and agents of Legends Global, Mohegan Arena at Casey Plaza, their respective parent companies, subsidiaries, affiliates, advertising and promotion agencies, and the immediate family members (spouse, parents, children, siblings, and their respective spouses) and household members of each such employee are not eligible to participate.

The Contest is subject to all applicable federal, state, and local laws and regulations and is void where prohibited or restricted by law. Participation constitutes entrant’s full and unconditional agreement to these Official Rules. Entries submitted before the start or after the end of the Campaign Period will not be eligible. The Sponsor’s computer is the official timekeeping device for this Contest. All times referenced herein are Eastern Time (ET) unless otherwise noted.

During the Campaign Period, eligible participants may enter the Contest by visiting the official contest entry page at https://www.moheganarenapa.com/summer-send-off/ and completing and submitting the online entry form as directed. All required fields must be completed for an entry to be considered valid.

Limit one (1) entry per person per day during the Campaign Period. Multiple entries in excess of the stated limit, entries generated by script, macro, bot, or other automated means, and entries that do not conform to or satisfy all requirements of these Official Rules may be disqualified. The use of any device or software to automate the entry process is prohibited and will result in disqualification.

Entries become the property of the Sponsor and will not be acknowledged or returned. The Sponsor is not responsible for lost, late, incomplete, misdirected, garbled, or illegible entries, or for failures, malfunctions, or errors of any telephone network, computer online system, server, provider, equipment, software, or any combination thereof.

One (1) winner will receive the prize described above. The total approximate retail value of all prizes is $90.00. Prizes are non-transferable, non-assignable, and may not be substituted or redeemed for cash, except at the sole discretion of the Sponsor. The Sponsor reserves the right to substitute a prize of equal or greater value if the advertised prize becomes unavailable for any reason.

Prizes are awarded “as is” and without warranty of any kind, express or implied. All taxes, fees, and expenses not specifically described herein are the sole responsibility of the winner. The winner must comply with all applicable federal, state, and local tax laws. Actual value of prize may vary. The Sponsor assumes no responsibility for any cancellation or postponement of the event associated with this prize.

On or about Thursday, August 13, the Sponsor will select one (1) potential winner in a random drawing from among all valid eligible entries received during the Campaign Period. The odds of winning depend on the total number of eligible entries received.

The potential winner will be notified via the contact information provided at the time of entry (e.g., email or telephone). The Sponsor will make a reasonable effort to contact the potential winner. If the potential winner cannot be reached within seventy-two (72) hours of the first attempted notification, or if the potential winner is found to be ineligible, has not complied with these Official Rules, or declines the prize, the Sponsor reserves the right to disqualify that potential winner and select an alternate winner from the remaining eligible entries.

The winner may be required to execute and return an Affidavit of Eligibility and Liability/Publicity Release (where lawful) within the timeframe specified in the notification. Failure to return such documentation within the required timeframe may result in disqualification and selection of an alternate winner.

The odds of winning depend on the total number of eligible entries received during the Campaign Period. The Sponsor makes no representations or warranties regarding the odds of winning.

All entries must be submitted through the official entry page during the Campaign Period. Entries that are incomplete, illegible, contain false or fraudulent information, are generated by automated means, or fail to meet any requirement of these Official Rules will be disqualified. The Sponsor reserves the right to verify the eligibility of all entrants and entries at any time.

By entering, each participant represents and warrants that their entry does not violate any applicable law, rule, or regulation, and does not infringe upon the rights of any third party.

By entering the Contest, each participant grants the Sponsor and its designees a non-exclusive, perpetual, worldwide, royalty-free license to use, reproduce, modify, publish, broadcast, and otherwise exploit the entry and any name, likeness, photograph, voice, biographical information, and statements submitted by the participant in connection with the Contest for advertising, promotional, trade, or any other purpose, in any medium now known or hereafter devised, without additional compensation, notification, or consent, except where prohibited by law.

The winner agrees that their name, city/state of residence, and winning entry (if applicable) may be used by the Sponsor for promotional and marketing purposes without additional compensation.

Personal information collected in connection with this Contest will be used by the Sponsor for administration of the Contest, prize fulfillment, and other legitimate business purposes. By entering, participants consent to the collection and use of their personal information by the Sponsor in accordance with Sponsor’s Privacy Policy. The Sponsor will not sell or disclose participants’ personal information to unaffiliated third parties for their direct marketing purposes without consent, except as required by law.

The Sponsor reserves the right, in its sole discretion, to cancel, modify, terminate, or suspend this Contest, in whole or in part, at any time and without prior notice, in the event of any cause beyond the reasonable control of the Sponsor that, in the Sponsor’s sole judgment, corrupts or adversely affects the administration, security, fairness, or proper conduct of the Contest, including but not limited to tampering, unauthorized intervention, fraud, technical failures, or other causes beyond the Sponsor’s control.

All decisions made by the Sponsor regarding the Contest are final and binding. The Sponsor is not responsible for: (a) any incorrect or inaccurate information, whether caused by participants, printing, typographical errors, or technical errors; (b) technical failures of any kind; (c) unauthorized human intervention; (d) technical limitations or traffic congestion on the Internet or at any website; or (e) any injury or damage to participants’ or any other persons’ computer or mobile device related to or resulting from participating in or downloading any material in connection with the Contest.

If, for any reason, the Contest is not capable of running as planned, including due to infection by computer virus, bugs, tampering, unauthorized intervention, fraud, technical failures, or other causes beyond the Sponsor’s control that corrupt or affect the administration, security, fairness, or proper conduct of the Contest, the Sponsor reserves the right to cancel, terminate, modify, or suspend the Contest.

By entering this Contest, participants agree to release, defend, indemnify, and hold harmless Legends Global, Mohegan Arena at Casey Plaza, and their respective parent companies, subsidiaries, affiliates, licensees, officers, directors, employees, agents, partners, successors, and assigns (collectively, “Released Parties”) from and against any and all claims, damages, losses, costs, and expenses (including reasonable attorneys’ fees) arising out of or related to: (a) participation in this Contest; (b) the acceptance, use, or misuse of any prize; (c) any violation of these Official Rules; (d) any personal injury, death, or property damage; or (e) any claims based on rights of publicity, privacy, or defamation.

Released Parties shall not be liable for any printing, typographical, administrative, or technological errors in any materials associated with the Contest. The Sponsor makes no representations or warranties concerning the appearance, safety, or performance of any prize. All warranty and condition terms, express and implied, are hereby disclaimed.

The winner is solely responsible for the payment of all applicable federal, state, and local taxes, fees, and charges on prize winnings. The Sponsor may require the winner to complete tax forms prior to prize distribution. If the winner cannot provide required tax information or documentation, the Sponsor reserves the right to disqualify such winner and select an alternate. Prizes valued at $600.00 or more may be reported to the Internal Revenue Service on IRS Form 1099.

EXCEPT WHERE PROHIBITED BY LAW, AS A CONDITION OF PARTICIPATING IN THIS CONTEST, EACH PARTICIPANT AGREES THAT: (1) ANY AND ALL DISPUTES AND CAUSES OF ACTION ARISING OUT OF OR CONNECTED WITH THIS CONTEST, OR ANY PRIZES AWARDED, SHALL BE RESOLVED INDIVIDUALLY, WITHOUT RESORT TO ANY FORM OF CLASS ACTION; (2) ANY AND ALL CLAIMS, JUDGMENTS AND AWARDS SHALL BE LIMITED TO ACTUAL OUT-OF-POCKET COSTS INCURRED, INCLUDING COSTS ASSOCIATED WITH ENTERING THIS CONTEST, BUT IN NO EVENT ATTORNEYS’ FEES; AND (3) UNDER NO CIRCUMSTANCES WILL PARTICIPANT BE PERMITTED TO OBTAIN AWARDS FOR, AND PARTICIPANT HEREBY WAIVES ALL RIGHTS TO CLAIM, PUNITIVE, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR ANY OTHER DAMAGES, OTHER THAN FOR ACTUAL OUT-OF-POCKET EXPENSES.

Any dispute arising out of or relating to these Official Rules or this Contest that cannot be resolved through direct discussion shall be settled by final and binding arbitration administered by a mutually agreed-upon arbitration service, in accordance with its then-current commercial arbitration rules. The arbitration shall take place in Wilkes-Barre Township, Pennsylvania. The decision of the arbitrator shall be final and binding upon all parties and may be entered as a judgment in any court of competent jurisdiction.

Participants agree that any claims or disputes must be brought on an individual basis only, and not as a plaintiff or class member in any purported class or representative action. Participants expressly waive any right to participate in a class action.

These Official Rules shall be governed by and construed in accordance with the laws of the Commonwealth of Pennsylvania, without giving effect to any choice of law or conflict of law rules or provisions that would cause the application of the laws of any other jurisdiction. Any legal proceedings arising out of this Contest or relating to these Official Rules that are not subject to arbitration shall be brought exclusively in the state or federal courts located in Wilkes-Barre Township, Pennsylvania, and each participant consents to the personal jurisdiction of such courts.

Winner list requests must be received within sixty (60) days of the end of the Contest.
